EULA - End User License Agreement

Installing and using this software means explicit acceptance of the terms and conditions of the EveryWAN Remote Support Personal Edition software license with Sparus Software.

The Product is protected by copyright, owned by Sparus Software and its suppliers. Any use of the Product other than those authorized under this license or copyright is prohibited.

The Product is provided as freeware. The Product is a limited and free version of EveryWAN Remote Support Enterprise Edition, which is part of the EveryWAN Mobility Manager solution. This license does not entitle you to use any other product, including future updates or upgrades of the Product, which Sparus Software may decide to submit to other licensing terms, or to use any other product, including software which are part of EveryWAN Mobility Manager.

You may use the Product with a device supported by the Product as stated in the Products documentation, connected to the computer where the Product is installed through a direct local wired connection to the computers hardware port or through a local Bluetooth connection, excluding any other connection type (including but not limited to other wired or wireless connections, WiFi, LAN, WAN, the Internet, cellular networks, GPRS, etc.).

You may not alter, transform, modify, build upon the Product, make a derivative work from the Product or integrate the Product into another software, hardware or solution.

You are granted the right to share, to use and to make an unlimited number of copies of the Product, and to distribute them provided (i) the recipients of the Products obtain the Product for free; (ii) the Product is provided in compliance with these terms and conditions; and (iii) this license is attached to Product in an unmodified form. Any reselling of the Product is strictly forbidden. Any authorized copies that you make, whether on a tangible media or not, are the intellectual property of and are owned by Sparus Software and its suppliers.

The Product is provided "as-is". No warranty of any kind is expressed or implied, all warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose are disclaimed, whether in relation to supported devices for the Product or not. The copyright owner or the contributors author will not be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including, but not limited to, procurement of substitute goods or services; loss of use, data, or profits; or business interruption) however caused and on any theory of liability, whether in contract, strict liability, or tort (including negligence or otherwise) arising in any way out of the use of this software, even if advised of the possibility of such damage.

This license may be terminated by Sparus Software in case of breach of these terms and conditions, without need of a prior notice.

The present terms and conditions are governed by and construed in accordance with the substantive laws in force in France, and the competent courts of Paris (France) shall have exclusive jurisdiction for any litigation relating to these terms and conditions.

By installing and using this software, you personally confirm that you have read these terms and conditions of the EveryWAN Remote Support Personal Edition software license, and that you undertake to comply with them. Otherwise, please quit this software program.
